Q - Why isn't this also hearsay? How is it better than זיגוד? The מהרי"ק didn't mention that there were 2 witness. Perhaps witnesses are not needed to establish possible origins to discredit the קול. Though צ"ע Aug 7, 2026
I.e. The Rif didn't quote the part of the Gemara stating that it was רב ורב יהודא who where there. This implies that he learns that the fact that they happened to be תלמידי חכמים was not necessary for the halachah. Aug 7, 2026

This implies that the reason that the others can't hate the נידון is b/c עד אחד is not considered a ידיעה ברורה (and not because of a procedural problem disqualifying what he saw). Thus, something which did meet the level of ידיעה ברורה would suffice. Aug 7, 2026
The root is different than מחה (protest). As per AI, The form שהמחוהו is a Hif'il causative construction (המחה) meaning "whom they [the community] empowered/authorized" — it comes from the same semantic family used in phrases like "מחו בידו" or "המחו לו כח," where the sense is closer to granting standing or power of attorney to someone, similar to the modern Hebrew legal term ייפוי כוח (power of attorney) or the Aramaic/Talmudic notion of מינוי (appointment).Perhaps this was meant as שהמנוהו (i.e. one appointed by the public to rule them). Q - Is this acceptance of a קול based on halachic psak from the Gemara or common sense (in which case other forms of proof which are equally likely would also apply) Aug 7, 2026
Amaraic for "teaching" (i.e. not a formal דין). Word has the same root as modern Hebrew word "Ulpan" (AI) Aug 7, 2026
